These terms are the agreement between you and Habit Duck for using the
mobile app and the habitduck.com website. By creating an account
or using the service, you accept what follows. It is written to be understood: if
anything is unclear, email us at
support@habitduck.com before accepting.
1. What Habit Duck is
Habit Duck is a habit-tracking app built around a virtual pet: a duck that reflects how
consistent you are. It includes daily habit logging across life areas, a personal
calendar, a Pomodoro timer and a wardrobe of cosmetics for the duck. The website also
offers a Pomodoro that runs in your browser, with no account.
It is an entertainment and personal-organisation service. Neither the
app nor the site provides professional services of any kind.
2. Minimum age
You must be 13 or older to use Habit Duck. In European Economic Area
countries where the digital age of consent is higher, that age applies instead (up to
16). If you are a minor in your country but above that threshold, you need permission
from your parent or guardian.
3. Your account
You need an account to use the app. You can create one with email and password, or with “Continue with Google”.
The details you give must be accurate, and the email must be yours.
You are responsible for keeping your password safe and for what happens under your account. Tell us if you think someone else got in.
An account is for one person: don't share or sell it.
You can delete it at any time from Settings → Account. See Delete my account.
Your progress travels with your account. Habits, duck, calendar and
preferences are stored on the phone and also in a copy tied to your account, so
reinstalling the app or switching phones gives them back when you sign in.
The image you add to your schedule is the exception: it stays on the
phone only and is not restored. Delete the account and the copy goes with it.
4. Your content
What you write and upload — your habit names, your calendar events, your duck's name,
the image you add to the calendar — is yours. It is processed on your
device and we don't publish it, share it or use it for anything else. We ask for no
licence over it because we don't need one: it never leaves your phone.
You are responsible for having the right to use what you upload (for example, a photo
you set as your calendar image).
5. Not medical advice
Habit Duck is a gamification tool, not a medical device. Its
indicators — the duck's “health”, the per-area bars, the level — are
game mechanics computed from what you tick, not a measure of your
physical or mental health.
They are no substitute for a professional's opinion. If you have a
health problem, consult a medical or mental-health professional. And your duck getting
sick or dying in-game carries no real meaning or consequence: it is a
way of reminding you of your habits, nothing more.
6. The free version and ads
The app can be used for free. In the free version you can manage
4 habits of your own. You will also be able to
watch 3 ads to unlock a 5th habit for 30 days,
renewable by watching them again.
If at the end of that period you have more habits than your plan allows, the extra ones
are paused: they stay saved and you can delete them, but they don't
count and don't affect your duck until you unlock the slot again or subscribe.
We never delete your habits for this reason.
Ads are not active yet in the current version. When they are, they will
appear only where this section describes, and we will ask for whatever consent the law
requires.
7. Premium subscription
With a Premium subscription you get:
Unlimited habits, without the free version's cap.
No ads.
The garments marked with 👑 in the wardrobe, which without a subscription can only be tried on inside it.
2 revive tokens per cycle, to bring your duck back instantly if it
dies. The balance refills to 2 every 90 days; it does not accumulate
(if one was left over, the next cycle still starts at two, not three) and it is
lost if you cancel.
Billing, renewal and cancellation
There are two options, monthly and yearly. The subscription is purchased and billed through Google Play, at the price for your country shown to you before you confirm.
For now there is no free trial: the first charge is made when you subscribe.
It renews automatically until you cancel.
You can cancel any time from your Google Play account. On cancelling you keep access until the end of the period already paid for.
Refunds follow Google Play's policy and whatever rights your country's law grants you. We don't process payments and have no access to your banking details.
If the price changes, we will tell you in advance and you'll be able to cancel before it applies.
None of this is active yet: in the current version nothing can be paid
for, and the subscription state exists only internally for development.
8. Virtual items
Cosmetics, revive tokens, XP, levels and any other in-game element are
limited use licences inside the app, not property you own. They have no
monetary value, they are not money, and they
cannot be sold, transferred, exchanged or refunded separately. We may
adjust game mechanics (numbers, balance, catalogue) to improve them.
9. Acceptable use
By using Habit Duck you agree not to:
Try to access other people's accounts or data.
Modify the app, reverse-engineer it, or alter game state to get paid features without paying for them.
Manipulate the device clock or use other means to fake your progress or bypass the free plan's limits.
Use the service for unlawful activity, or try to take it down or overload it.
Copy, redistribute or resell the app, its artwork or its content.
10. Intellectual property
The app, the site, the Habit Duck name, the design and
all of the duck artwork (sprites, cosmetics, illustrations) belong to
the Habit Duck project and are protected by copyright. You get a personal,
non-exclusive, revocable licence to use the app as offered. None of this artwork may be
extracted or reused without written permission.
11. Availability and changes
The service is provided “as is” and may have outages, bugs or changes.
We work to keep it running well, but we don't guarantee continuous availability or that
it will be error-free. We may add, change or remove features; if a change materially
affects something you paid for, we will tell you.
If we update these terms we will change the date in the header and notify you in the app
when the change is relevant. Continuing to use the service afterwards means accepting
the new version.
12. Liability
To the extent permitted by law, Habit Duck is not liable for indirect damages, loss of
local data, lost profits, or decisions you make based on what you see in the app. Our
total liability is limited to what you paid for the service in the
12 months before the event giving rise to it.
None of the above limits the consumer rights your country's law grants you and that
cannot be waived.
13. Termination
You can stop using Habit Duck whenever you like by deleting your account and
uninstalling the app. We may suspend or close an account that breaches these terms or is
used to harm other people or the service; where possible, we will warn you first. On
termination, what the Privacy Policy says about data deletion
applies.
14. Governing law
These terms are governed by the laws of the Republic of Ecuador and any
dispute will be submitted to its courts, without prejudice to your right, as a consumer,
to bring proceedings in the courts of your place of residence where the law allows it.
